Magna Fab provides industrial metal fabrication and manufacturing services, including but not limited to:

• Custom metal fabrication and welding
• Pressure vessel manufacturing
• Structural steel fabrication
• Process piping systems
• Custom equipment manufacturing
• Engineering and design services

Specific services, deliverables, timelines, and pricing are defined in individual contracts and work orders agreed upon between Magna Fab and the client.

3. Eligibility

Our Services are intended for business users. To use our Services, you must:

• Be at least 18 years of age
• Have the legal authority to enter into contracts on behalf of yourself or your organization
• Provide accurate and complete information when requested

By using our Services, you represent and warrant that you meet these eligibility requirements.

4. User Responsibilities

When using our Site or Services, you agree to:

• Maintain the confidentiality of any account credentials or access information provided

Your Property

You retain ownership of any project specifications, drawings, technical documents, and other materials you provide to us. By submitting these materials, you grant Magna Fab a non-exclusive license to use them for the purpose of providing Services to you.

Work Product

Ownership of fabricated products and related documentation shall be as specified in the applicable contract or work order.

7. Disclaimer of Warranties

THE SITE AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components. We make no warranties about the accuracy, reliability, or completeness of any content on the Site.

Specific warranties for fabrication services and products, if any, are provided in individual contracts and are limited to the terms stated therein.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MAGNA FAB SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR SERVICES.

IN NO EVENT SHALL MAGNA FAB'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT YOU PAID, IF ANY, TO MAGNA FAB FOR ACCESS TO THE SITE OR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM.

Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability, so some of the above limitations may not apply to you.

The Site may contain links to third-party websites or services that are not owned or controlled by Magna Fab. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services.

You agree to defend, indemnify, and hold harmless Magna Fab and its officers, directors, employees, agents, and affiliates from and against any claims, damages, obligations, losses, liabilities, costs, or expenses (including reasonable attorney's fees) arising from:

• Your violation of these Terms
• Your violation of any third-party rights
• Any content or materials you submit to us

11. Termination

We may terminate or suspend your access to the Site and Services immediately, without prior notice, for any reason, including breach of these Terms.

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States of America, without regard to its conflict of law provisions.

Any disputes arising out of or relating to these Terms or your use of the Site or Services shall be resolved in the state or federal courts located in Johnson County, Texas, and you consent to personal jurisdiction in those courts.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy and any other legal documents referenced herein, constitute the entire agreement between you and Magna Fab regarding the use of the Site and Services.
